Terms of sale
Article 1 — Purpose
These general terms and conditions of sale govern the sales of swimwear and items of the SWIMBIKI brand, concluded between BIBI-TRIKI Ewen Esaie (Ewen Management) and any consumer customer, on the website swimbiki.com.
Article 2 — Products
The products offered are described and presented as accurately as possible. Photographs are for illustrative purposes only and are not contractually binding. Products are offered subject to availability.
Article 3 — Price
Prices are shown in euros, including all taxes. (If you benefit from the VAT exemption threshold: "Prices are indicated in euros. VAT not applicable, article 293 B of the French General Tax Code.") Delivery charges are shown separately before order confirmation. We reserve the right to change our prices at any time, it being understood that the applicable price is the one in effect at the time of the order.
Article 4 — Order
Your order will be validated after acceptance of these Terms and Conditions and confirmation of payment. A confirmation email summarizing your order will be sent to you. We reserve the right to cancel any order that appears abnormal or fraudulent.
Article 5 — Payment
Payment is made at the time of ordering using the methods offered on the website (credit cards, Apple Pay, Klarna, and other methods displayed at checkout). Transactions are secured by our payment providers. The order is processed after payment confirmation.
Article 6 — Delivery
Delivery terms and times are detailed in our Shipping Policy. Risks associated with transport are transferred to the customer upon physical receipt of the products.
Article 7 — Right of withdrawal
In accordance with the articles LPursuant to Articles 221-18 et seq. of the French Consumer Code, you have a 14-day withdrawal period. The terms and conditions are detailed in our Return and Refund Policy.
Hygiene exception: in compliance with article L221-28 4°, swimsuits from which the hygienic protection has been removed cannot be returned.
Article 8 — Legal Guarantees
All our products benefit from the legal guarantee of conformity (art. L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code). In case of a defect, contact us at contact@swimbiki.com.
Article 9 — Responsibility
We cannot be held responsible for misuse or improper care of the products. Our crochet jerseys require hand washing in cold water with mild soap and flat drying.
Article 10 — Personal Data
The processing of your data is detailed in our Privacy Policy, which complies with the GDPR.
Article 11 — Disputes and Mediation
In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the consumer may resort to consumer mediation or the European online dispute resolution platform (https://ec.europa.eu/consumers/odrFrench law is applicable, subject to the protective provisions of the consumer's country of residence within the EU.
